1.3. In the event of acceptance of the conditions of the Agreement set forth below, the person performing the acceptance of this Offer becomes the Buyer (in accordance with Part 3 of Article 438 of the Civil Code of the Russian Federation, acceptance of the offer is equivalent to the conclusion of the Agreement on the terms set forth in the Offer).

1.4. The Buyer and the Seller are hereinafter jointly referred to as the "Parties", and individually as a "Party".

1.5. In accordance with Articles 434, 435, and 438 of the Civil Code of the Russian Federation, the Agreement is concluded by the Buyer's acceptance of the Offer, that is, by the Buyer's expression of full and unconditional acceptance of the terms of the Offer.

1.6. Acceptance of the Offer, in accordance with Article 438 of the Civil Code of the Russian Federation, is the moment when the Buyer places an order for the Goods and makes payment for the Goods on the Seller's Website. The moment of the conclusion of the Agreement is considered to be the moment the Seller receives the Buyer's acceptance of the Offer.

1.7. By concluding the Agreement, the Buyer understands the significance of their actions and is capable of directing them, and is not under the influence of misconception, fraud, violence, or threat.

1.8. Prior to accepting the Offer, the Buyer is obliged to familiarize themselves with all conditions of this Offer. A Buyer who has accepted the Offer is deemed to have familiarized themselves with and agreed to all conditions of the Offer in the form in which they are set forth in the text of the Offer, and, in accordance with the Civil Code of the Russian Federation, is considered a person who has entered into contractual relations with the Seller. 1.9. By accepting the terms of the Offer, the Buyer fully confirms their legal capacity to conclude the Agreement, and also realizes the responsibility for the obligations imposed on them as a result of concluding the Agreement.

1.10. By accepting the terms of the Offer, the Buyer, being an individual, simultaneously agrees to the processing of their personal data by the Seller in accordance with the Privacy Policy. The current version of the Privacy Policy is posted on the Website, and the Buyer is obliged to familiarize themselves with all its conditions prior to accepting the Offer.

1.11. In the event that the Buyer does not agree with any of the provisions of the Offer, the Appendices to the Offer, or the Personal Data Processing Policy, the Buyer shall not accept the Offer.

1.12. From the moment of acceptance of this Offer, the Buyer is not entitled to refer to ignorance of the terms of the concluded Agreement.

1.13. This Agreement is developed in accordance with the current legislation of the Russian Federation on the remote retail sale and purchase of goods, consumer rights protection, and the rules for the sale of certain types of goods. In the event of a contradiction between individual provisions of the Agreement and the norms of current legislation, the norms of current legislation shall apply. The invalidity of individual provisions does not entail the invalidity of the Agreement as a whole.

2. Subject of the Agreement

2.1. The subject of the Agreement is to provide the Buyer with the opportunity to purchase Goods indicated on the Website for personal, family, household, and other needs.

2.2. "Goods" means any item that the Seller offers for sale on the Website by indicating the name of the item, its description, a photograph of the Goods, the price, information about the author, manufacturer, necessary information about the consumer properties of the Goods, about the Seller, about the manufacturer of the Goods, and other information required by law, taking into account the specifics of the sale of certain types of goods, with which the Buyer has the opportunity to familiarize themselves before placing an order. All goods are non-food items.

3. Order Placement Procedure

3.1. The Buyer can place an order independently on the Website through the order form. An order can be placed for any Goods posted on the Website that are in stock at the Seller's warehouse.

3.2. To place an order, the Buyer fills out the order form, indicating their name, phone number, e-mail, delivery address, and the quantity of the Goods.

3.3. The order is considered placed at the moment the "Place Order" button is clicked.

3.4. Upon receiving the order from the Buyer, the Seller proceeds to process and assemble it. The Seller does not guarantee to the Buyer the availability of the ordered Goods at the moment the order assembly begins. The absence of the Goods specified in the order at the moment the order assembly begins, as well as their subsequent exclusion from the order, does not constitute a violation of the Buyer's rights by the Seller.

3.5. After processing the order, the Seller sends the Buyer a notification of order receipt to their e-mail address or informs the Buyer by phone, including specifying the final list of Goods assembled in the order, the total cost of the order (including delivery costs and other payments in favor of the Seller), and other essential information. The Buyer is obliged to confirm the processed order or refuse to confirm it. If the Buyer does not confirm the order, the order is canceled without any demands or claims from the Buyer, and the Agreement is considered not concluded.

3.6. Confirmation of the order by the Buyer is carried out by making an advance payment in the manner defined in Section 4 of this Agreement.

3.7. At the moment of confirmation of the order by the Buyer, the Agreement is considered concluded, and the Parties acquire rights and obligations regarding the confirmed order.

4. Payment Procedure

4.1. The cost of the Goods, excluding delivery costs, is indicated on the Website. The Seller reserves the right to unilaterally change the prices of the Goods.

4.2. Delivery of the Goods is carried out for a separate fee, which is indicated when placing the order.

4.3. The cost of the order is formed from the cost of the Goods and the cost of delivery, and is indicated when placing the order on the Website.

4.4. Payment for the order is made by the Buyer only after its cost has been formed in accordance with clause 4.3 of this Agreement, by making a prepayment for the order.

4.5. The Seller informs the Buyer in an electronic notification sent by the Seller to the Buyer's e-mail address upon receipt of the order, including the quantity of the ordered Goods, the delivery address, the chosen delivery method, and the full cost of the order, consisting of the cost of the Goods and the cost of delivery.

4.6. The Buyer's obligation to pay for the order is considered fulfilled at the moment the full amount of the prepayment is credited to the Seller's bank account. If the payment is not received, the order is considered canceled, about which the Seller notifies the Buyer by e-mail or SMS message.

5. Goods Delivery

5.1. The Seller delivers the Goods within the timeframes agreed with the Buyer upon order confirmation, to the Buyer's address specified when placing the order. The Buyer is responsible for the accuracy of the information provided, which is necessary for the Seller to fulfill its delivery obligations. In the event of the Seller's failure to fulfill such obligations due to the Buyer's inaccurate information, the Seller is not responsible for the non-delivery of the order. Repeat delivery, as well as other actions by the Seller aimed at the Buyer receiving the order and specified in this Agreement, are carried out only by mutual agreement of the parties, with the corresponding additional expenses borne by the Buyer.

5.2. Upon receipt of the Goods, the Buyer is obliged to provide the order number and present an identity document. If the Buyer is a legal entity, its representative presents a power of attorney to receive the goods and an identity document.

5.3. Upon transfer of the Goods, the Buyer checks its external appearance, completeness, and quality, thereby confirming that they have received the Goods and have no claims regarding its external appearance, quantity, completeness, or quality.

5.4. Ownership of the Goods passes to the Buyer at the moment of actual transfer of the Goods to them, provided that it has been fully paid for.

6. Modification and Cancellation of the Order

6.1. If, after placing the order, the Seller discovers the absence of the ordered Goods or the required quantity in the warehouse, the Seller shall immediately notify the Buyer of this by phone or e-mail.

6.2. If the order is not paid, the Buyer has the right to cancel the placed order in whole or in part by phone or e-mail at any time before its delivery. Payment for such an order (or part of the order) is not made. If a Buyer who is not a consumer declares a complete refusal of the order at a time when the order has already been handed over for delivery, they are obliged to pay the previously agreed cost of delivering the order.

6.3. If the Buyer cancels a prepaid order in the manner provided for in clauses 6.1 and 6.2 of the Offer, the Seller shall return the amount paid for the order (and in the case of a partial cancellation, the overpaid amount) to the same bank details from which it was received by the Seller. The refund is made within 7 (seven) working days from the date of order cancellation.

6.4. By agreement with the Seller, the Buyer has the right to modify the order no later than 24 hours before the start of the agreed delivery time window. If the order is prepaid, the Seller adjusts its cost and informs the Buyer of the amount that needs to be paid additionally, or returns the overpayment to the Buyer's account in the manner provided for in clause 6.3 of the Offer.

7. Return and Exchange of Goods

7.1. If the Buyer discovers defects in the Goods, they have the right to present the Seller with the demands provided for by the Civil Code of the Russian Federation and other legal acts. This includes the right to terminate the Agreement, return the defective Goods to the Seller, and demand a refund of the money paid. A Buyer who is a consumer also has the right to present demands provided for by the Law of the Russian Federation "On Consumer Rights Protection" dated 07.02.1992 No. 2300-1, the Rules for the Sale of Goods under a Retail Sale and Purchase Agreement, approved by Decree of the Government of the Russian Federation dated 31.12.2020 No. 2463, and other legal acts in the field of consumer rights protection. The procedure for presenting demands is determined by the specified legal acts.

7.2. Claims regarding the quality of the Goods must be sent in writing to the Seller's e-mail address. The claim must indicate the full name (or company name) of the Buyer, the order number and date, the date of payment, and the date of transfer of the Goods, as well as describe the identified defects, the date, and the circumstances of their discovery. Photographs must be attached to the claim.

7.3. A Buyer who is a consumer has the right to refuse Goods of proper quality within 7 (seven) days from the date of their transfer, provided that their commercial appearance, consumer properties, and a document confirming the fact and conditions of the purchase are preserved. If the document is not preserved, other proof of purchase may be presented. The Buyer draws up a statement for the return of the Goods, indicating their full name, order number and date, date of payment, and date of transfer of the Goods.

7.4. Goods, both of proper quality and with defects, in the event of their return under the conditions of the Offer, may be returned by the Buyer by handing them over at the Seller's location.

7.5. Upon return of the goods (both of proper quality and with defects), the Seller shall return the cost of the Goods to the Buyer no later than 10 (ten) days from the moment the Buyer demands the refund, to the bank details from which the money was received by the Seller or which the Buyer provides in writing. If a proper quality item is returned, the cost of return delivery by the Seller's courier of the returned Goods is deducted from the refund amount.

7.6. In accordance with the Law of the Russian Federation "On Consumer Rights Protection" and Decree of the Government of the Russian Federation dated January 19, 1998, No. 55, books belong to goods that are not subject to return or exchange for a similar item, unless their non-conformity with the ordered item or the presence of a hidden defect is established.

8. Liability of the Parties

8.1. The Parties to the Agreement bear responsibility for the proper execution of the Agreement in accordance with the current legislation of the Russian Federation.

8.2. The Buyer assumes full responsibility and risks associated with the correct placement of the order, the indication of their data and the data of the order recipient, and the filling out of forms when paying for the order. If, as a result of such risks, the Buyer incurs losses, the Seller will not be obliged to compensate them to the Buyer, unless the Buyer proves that such losses occurred due to the Seller's fault.

8.3. The Parties are released from liability for partial or complete non-fulfillment of obligations under the Agreement if such non-fulfillment was a direct consequence of force majeure circumstances that arose after the conclusion of the Agreement, as a result of extraordinary events, namely: fire, flood, hurricane, and earthquake, or the imposition by state authorities of restrictions on the activities of any of the Parties, and if these circumstances the Parties could neither foresee nor prevent by reasonable measures.

9. Dispute Resolution

9.1. Disputes and disagreements that may arise under the Agreement shall be resolved by observing a pre-trial (claim) procedure.

9.2. The term for submitting a claim by the Buyer is 15 (fifteen) calendar days from the moment of the violation of the Buyer's rights.

9.3. The term for the Seller to consider the Buyer's claim is 7 (seven) calendar days from the moment of its receipt from the Buyer, provided that the Buyer is identified.

10.4. The Agreement may be terminated unilaterally by the Seller by sending a corresponding notice to the Buyer in the event of repeated violations by the Buyer of the terms of the Agreement, in particular, the procedure for making advance payments and the procedure for order delivery. Upon such termination, the Buyer loses the right to purchase Goods from the Seller in the future.

10.5. The Seller has the right to make changes to the Agreement with the mandatory posting of the corresponding information on the Website. Any changes are binding on the Buyer and are considered accepted by them after 2 (two) calendar days from the moment of their publication on the Website.
